Military pensions ordinance revoked 24/01/2011 |

Soldiers and policemen say that the government ordinance was not transparent and was not put up for public debate before implementation. They say many officers have not been able to produce the certificates attesting to their career histories before the established deadline, which has triggered cases of discrimination.
The trade union of dismissed, reservist or retired soldiers say that, following re-calculation, the officers’ pensions will fall by 50 - 60%, calling the government’s decision ‘a disgrace’. The trade union vice-president, Valeriu Pricina, says that an injustice has been committed because soldiers belong to a privileged category, also recognized at European Union level.
“We enjoy the constitutional principle of non-retro-activeness and of property acquired through organic law, therefore we should be practically immune to any attacks. Furthermore, there are two European directives that place us in the second pillar, together with magistrates, as regards special pensions and connected rights. Reforms can only be made if backed by relevant legislation. We’ll try to solve this problem and we’ll go to Brussels and even the Court in Luxembourg”.
The Romanian President, Traian Basescu, said Sunday, after a meeting with the cabinet devoted to this topic, that the decision of the High Court of Cassation and Justice to suspend the re-calculation of soldiers’ pensions had to be observed. He also said that the government would issue a further decision regarding the extension of the deadline for the re-calculation of such pensions by the end of the year. The decision should take into account the issues that were invalidated by court.
It’s obvious that the re-calculation of soldiers’ pensions is part of the larger-scale process of reducing budget expenses, in the context of the domestic economic and financial crisis. The government is certain that pension re-calculation, though a very unpopular mechanism, will help stabilise the state budget – however, the military want to preserve the privileges and pensions they’ve enjoyed so far.
The conflict reveals not only a series of technical flaws regarding pension re-calculation but also the political tension between the government and opposition that surfaces with every scandal breaking in Romania.
