THE KOSOVO ISSUE AND ITS IMPACT ON BUCHAREST 20/02/2008

Even if the Romanian President and Parliament agree that the decision of the unilateral proclamation of independence of the Kosovo province fails to comply with international laws and principles of sovereignty, territorial integrity and with the principle of inviolability of borders, there are diverging opinions among politicians in Bucharest about the Romanian military presence in the area.

While the Romanian head-of-state favors the 175-strong Romanian police and gendarme force deployed as part of the UN mission to Kosovo to come under the authority of the EU, the Romanian Parliament calls on the Higher Defence Council to reconsider the need for the Romanian troops to remain in Kosovo. A possible withdrawal of the Romanian police and gendarme force from Kosovo should seriously be taken into consideration, says Romanian minister of the interior Cristian David:

“I do not think this discussion should be carried outside of the current operational framework, that is the Security Council resolution, a United Nation’s mandate which we are carrying out together with forces of other UN member states.”

The Defense Committee of the Romanian Senate believes the presence of the Romanian military in Kosovo has as a legal basis, namely the Resolution 1244 of the UN Security Council. The resolution especially emphasizes the inviolability of Serbian borders and is currently faced with a content fault. The chairman of the committee, Cristian Diaconescu, says that if the European Union wants to be engaged in Kosovo it needs either a new Security Council resolution or a commitment from all of the EU member states. Under these circumstances, Romania could decide to withdraw its forces from Kosovo, Cristian Diaconescu:

“I do not think this would qualify as a violation of the 2002 memorandum which committed us to participating in this mission.”

In a conference on security issues, Constantin Degeratu, presidential advisor on defence matters, said Romania may change its point of view according to how the situation would evolve in Europe, but especially according to national interests.

The point of view of the European Union it was expressed by the High European Representative for Common Foreign and Security Policy, Javier Solana. On a visit to Pristina on Tuesday, Solana said quote “the EU is unanimous on Kosovo and that is demonstrated by the fact that we will form our mission here. The EU mission will be established over the entire territory of Kosovo. Different member countries have their internal procedures for the new reality in Kosovo. Member countries can recognize its independence and they are doing so” unquote.

A good opportunity for identifying a viable solution for the Kosovo issue could be the Bucharest NATO Summit scheduled to take place between the 2nd and 4th of April.
