There are seven areas in which Romania is lagging behind in its European integration process, daily Romania Libera writes: the judiciary reform, agriculture, bio-diversity, pollution, the communication ombudsman, misleading advertising and the first car registration fee. In the opinion of the Romania Libera editors, the first of the areas in which Romania lags behind - the judiciary is maybe the most dangerous.

They recall that this month, Bucharest will get a list of the non- accomplishments, that might lead to an unhappy verdict and the activation of the safeguard clause. Equally disquieting are the failures in agriculture, although authorities managed to avoid, at the last moment, the activation of the safeguard clause.

At the end of 2007, Brussels decided not to activate the clause, following the progress made by the Romanian side in establishing the payment system and in making the Agency for Payments and Intervention in Agriculture operational. However, the European Commission pinpointed that it would monitor the situation closely and control the management of the European funds allotted to this sector. Another weak point is bio diversity, where delays were also recorded; Romania has already got warnings for ignoring the community legislation and for its failure to set up special protected areas for migratory wild birds or species in danger of extinction.

The European Commission has initiated the procedure for the infringement of the Accession Treaty in the pollution chapter as well, since Romania was unable to establish a monitoring mechanism for the greenhouse gas emissions. The European Commission has also warned Bucharest that it might start sanctioning procedures as regards the Law on the telecommunication ombudsman, unless the National Regulatory Authority in the field does not get in line with the European legislation.

Misleading advertising is also a point in which Romania is lagging behind on the European agenda, Romania Libera daily writes, as Bucharest has failed to meet the deadline - December the 12th by which its legislation in the field should have been harmonised. Brussels is also waiting for a solution of the Romanian authorities on the first car registration fee, introduced for second hand cars, a law which the Commission views as discriminatory and protectionist.

The Romanian government has postponed the decision, making only slight, surface changes on that fee; it seems to be prepared to maintain it, in spite of heavy penalties that should be paid if this law is not abrogated,- the daily RL comments. There is a risk however, that this fee triggers a sentence of the European Court of Justice that might oblige the authorities to eliminate the it and give back the money collected so far. Romania may refuse to abide by that sentence, but it will have to pay a heavy fine.

The Daily “Gandul” also reports that the first car registration fee imposed by the government infringes both the European Community Treaty and Romania and Bulgaria’s Accession Treaty. Evidence to that is that a Romanian citizen who sued the state for this fee won the case in court and got his money back, the journalists with Cotidianul daily write.
