ROMANIA RECEIVES MORE WARNINGS FROM BRUSSELS(29.11.2007)

11 months since it joined the European Union, Romania has started to adjust to its new status – that is to say, it has become accustomed with investigations and warnings from Brussels. By Wednesday, the country had totaled three such warnings. The Commission has started official investigations, as it suspects that state aid has been granted for the privatization of the Craiova Car Factory in southern Romania, the “Tractorul” Factory in Brasov, central Romania, and Petrotub Roman in the east. Additionally, a warning letter has been directed towards the agricultural sector, as decision makers in the field failed to meet the requirements of the Payment Agency by mid December.

This could lead to the activation of the safeguard clause, which is tantamount to loosing 110 million Euros worth of EU funds. The commission has also drawn attention to the fact that the first registration fee for secondhand cars, established by the Romanian government, runs counter to European principles. On Wednesday, two new warnings were received. The European Commission called again on Bucharest to abide by European regulations regarding the first registration fee.

The Commission also pointed to the improper functioning of the emergency telephone number 112. As regards the first registration fee for automobiles, EU decision makers have initiated the second stage of the procedure for sanctioning Romania. The Romanian government said, through the voice of its spokesperson, Camelia Spataru, that the fee was introduced in order to protect the environment.

”The main aim of this decision can be seen by the fact that the fee is in accordance with the degree of carbon dioxide pollution emitted by each car. This measure is also in line with European regulations stipulating the reduction of carbon dioxide emissions.”

The Commissioner for taxes and customs union, Laszlo Kovacs, has said he understands this stance, but considers the legislation in the domain is discriminatory, given the high fees imposed on used cars, as compared to new vehicles, and given the high fee which should be paid for used cars brought from other EU member states, as compared to similar cars from Romania. The European Commission has also drawn attention to the fact that emergency 112 phone calls made on mobile phones can’t be located, as is required by the union. However, this technical problem should primarily be solved by mobile phone operators, according to Bucharest, adding that the current legal framework related to the functioning of the respective number is perfectly compatible with EU regulations. Camelia Spataru again:

”All aspects underlined by the commission will be analysed and the necessary decisions will be made for this system to function at the parameters required at European level.”
