The Revision of the Romanian Constitution, under Debate |

The Parliamentary Committee for the Revision of the Constitution continues to look into the proposals made by civil society with a view to drafting a new Constitution, adapted to Romania’s new stage of development. In the first meeting, the Committee had rejected the amendments that referred to changing the governing structure of Romania from a semi-presidential republic into a parliamentary republic. They also rejected the proposal forwarded by the Hungarian ethnic minority represented in Parliament to eliminate the phrase “nation state”.
On Tuesday, in the second meeting, the Revision Committee introduced in the draft Constitution the word “region” which will complete the forms of administrative organization of Romania’s territory namely communes, towns/ cities and counties. They adopted the proposal to insert a coat of arms on Romania’s flag but rejected the idea to move the National Day from December 1st, which marked the Great Union of 1918, to May 10th marking the Monarchy Day.
They also rejected the idea to change the national anthem. The committee also established that discrimination according to color of skin, sexual orientation and genetic traits has to be forbidden. Related to this article, the Romanian Orthodox Patriarchate has issued a communiqué asking the Committee, on behalf of 85.6% of Romania’s population of Orthodox denomination, to take into account the need to protect the Romanian traditional and natural families, based on marriage between men and women.
EU membership has generated prolonged debates given that the national ethnic minorities group suggested the introduction of an amendment explicitly stipulating that Romania is a member country of the European Union. The amendment was rejected, as EU membership is sanctioned by treaties so there is no need to mention this in the Constitution as well. The Committee members also amended article 15 in the Constitution referring to Universality, introducing the provision that “the Romanian citizens are born and live free” which replaces the current wording “the Romanian citizens benefit from the rights and freedoms stipulated by the Constitution and other laws and have the obligations arising thereof”.
An article adopted unanimously was that referring to the secrecy of correspondence. Taking into account the developments in the IT field the Revision Committee has modified article 28 and introduced the secrecy of communications and electronic data traffic besides the secrecy of letters, telegrams and phone conversations.
