In its progress report made public in Brussels, the European Commission calls on Romania to put in place, until October, a plan of action in order to show its commitment to fighting corruption and strengthening the independence of the judiciary. Then, Romania will have to forward a briefing until March 2008, prior to the next report of the Commission due to be made public next summer. Bulgaria is called upon to do the same thing.

Analysts have noted that the monitoring report on Bucharest’s progress is better than the report on Sofia’s performance. However what is important is that the European Commission has decided to sanction neither Romania nor Bulgaria for the way in which they implement the reform of the judiciary, in other words, not to activate the safeguard clause which would have meant not to recognize the rulings of the courts in the two countries. But the demands in the reports are a clear sign that the European officials wish to keep political pressure on the two new member countries.

As regards the four objectives imposed on Romania at the time of its accession, the report shows that the poorest results are registered with regard to the settlement of high level corruption cases. The report points out the progress made by the National Anti-Corruption Directorate in dealing with those cases, but it criticizes the large number of suspended sentences, which undermines the progress made by investigators and impairs the public perception of the political commitment to fighting corruption. As to the other three objectives, the report notes certain progress, but a not very convincing one.

So, the activity of the High Council of the Judiciary has improved, but the lack of a coherent practice regarding the return of properties is a reason for anxiety. The passing of the Law on the National Agency for Integrity, which must contribute to eradicating high level corruption is highlighted as a substantial progress, which however must be further confirmed by practice. Finally, the European Commission calls on Romania to apply a strategy of combating corruption in the local administration and in other vulnerable sectors.

The conclusion of the report is that there must be no kindness in the fight against corruption and that Romania must intensify its efforts, to avoid future possible sanctions. Moreover, the Commission admits that achieving a viable justice system is a long lasting process.
