The law comes under scrutiny in Romania

justitieDue to an excess of legislation, the law in Romania has become unpredictable and difficult to implement. A study conducted by experts from the Justice Ministry and the Legislative Council, the main body with responsibilities in the field, indicates that almost 50,000 different pieces of legislation have been passed since 2000, many of which regulate similar or even identical legal situations. Needless to say, this makes their implementation a difficult task.




To solve the situation, the government has approved a memorandum drawn up by the Justice Ministry aimed at creating a systematic and coherent strategy to clarify the legal framework, a strategy to be implemented within 3 years of its adoption. The implementation of this strategy will be supported by the Justice Ministry jointly with the Legislative Council. Among others, the strategy proposes republication to simplify the application of regulations that have been subject to successive amendments; the elimination of parallelism issues; and the cancellation of regulations that are obsolete or contain provisions that contradict other regulations in force.

The strategy also aims at making an inventory of all pieces of legislation, including laws, ordinances and government emergency ordinances that have been subject to amendments in recent years and do not contain provisions concerning republication. Another measure targeted by the strategy aims at concentrating certain pieces of legislation in a given area into a single regulation. The regulations subject to amendment and addition under Law no. 187 from 2012 are a special case. Given the time left until the implementation of the new criminal regulations on the 1st of February 2014, the memorandum adopted by the government proposes two types of legal measures.

First, in order to prevent disruptions in the application of special laws, the amended pieces of legislation must be republished after the enforcement of the new regulation in the field of substantial criminal law. Secondly, any amendment, addition or cancellation of the legal provisions laid down in these regulations, as well as their republication, must take into consideration the solutions stipulated by the law regulating the application of the criminal code.
