Addressing Parliament Prime Minister Emil Boc said the Government’s initiative was completely in line with the European Union’s requirements, as the Union is monitoring the reform of the Romanian justice system, also trying to comply with the country’s new realities. “Romanian society needs to modernize itself, and such a need calls for the adoption of a new legal framework, regulated under the Civil Code and the Criminal Code. These two codes as well as the other two codes to follow, the Criminal Procedure Code and the Civil Procedure Code will contribute to implementing a faster and more cost-effective justice system for the citizen.”
The draft Civil Code includes such new provisions as the right to life, health or integrity, the right to privacy and the person’s dignity, as well as the right or respect for the deceased person’s memory. Also, the Civil Code legalizes the institution of pre-marital engagement. As for the Criminal Code, it simplifies law texts, avoids legislative overlapping and brings such new things as the right of a natural person to approach a dwelling place, and even brings further specifications on injuring the fetus. The liberal opposition has confirmed, through the National Liberal Party’s vice president Ludovic Orban that it is determined to file a censure motion. Liberal Vice President Ludovic Orban explains:
"We think these two Codes should not be passed in their present form, and the National Liberal Party cannot accept the Government’s disregard of public opinion and the civil society."
Although in opposition, the Democratic Union of Ethnic Hungarians in Romania announced it would not back the National Liberals’ stance as it approved of the content of the Legal Codes. Firmly challenging the codes and the procedure of taking responsibility, part of Romania’s civil society has resumed the criticism leveled at the government. Here is the Chief Executive of the Law Resource Center, Georgiana Iorgulescu.
"Actually the Codes are completely different from those submitted to Parliament – in their core structure, I mean – and I am very sorry that the Romanian Parliament takes part in this charade, instead of carrying through its mission, that of being the country’s legislator.
