The Revision of Romania’s Constitution

Presedintele Traian Basescu For the last two weeks, president Traian Basescu has promoted the revision of the Constitution and the country’s territorial and administrative reorganization as part of the same set of measures destined to reform the state. Amending the Constitution that both the rulers and the opposition have accepted in principle was the subject of a speech that the president made in Parliament. He claimed that the 2009 referendum allowed for a legitimate amendment to the Constitution. We recall that Romanians who voted in the referendum opted for a one-chamber Parliament and a maximum number of 300 MPs.


Although the Constitutional Court rejected some of the proposals included in the Constitution’s revision project, the president said he would give parliament the right to have the last say in the matter. Among amendments that the Court views as unconstitutional, there is one that refers to the elimination of the presumption that citizens’ wealth has been legally acquired and another one relating to parliamentary and ministerial immunity.



Traian Basescu: ‘’I think it would be a great error if you failed to accept immunity limitations where they currently exist, with the exception of arrests. I am talking about immunity for political statements and attitudes.’’



As for Romania’s territorial reorganization, Traian Basescu said: ‘’Governmental agencies smother city halls, through bureaucracy, be they in communes, towns or municipal cities, while county councils smother local administrations. We must allow the country to breathe freely, through two fundamental things: reducing the number of governmental agencies and handing over prerogatives to the local administrations on the one hand and creating space for the development of regional projects, on the other hand. This may be even more important than the former.’’



The presidential speech was boycotted by opposition parties, the Social Democratic party, the National Liberal Party and the Conservative Party, which have recently joined hands to form the Social Liberal Union. The 3 parties have rejected the president’s project to reorganize the territory and in turn put forth a plan expected to end in early elections. The project is still on standby, as it did not receive backing from the Democratic Union of Ethnic Hungarians in Romania (part of the government coalition, along with the Liberal Democratic Party, the president’s protégé). Through its administrative and territorial reorganization, Romania would no longer have been divided into 41 counties as it is at present, but into 8 large counties. That would have translated as a geographical projection of the existing 8 development regions.
