The Romanian government on Tuesday took responsibility for the law to change the Labor Code. As a result, the Social-Liberal Union of the three parties in the opposition, the Liberal, Social Democrats and the Conservatives, introduced a censure motion.


The motion will be discussed and voted on next Wednesday. The MPs who signed the motion specified that passing the Labor Code by taking responsibility was an abuse, and pointed out that the changes in the text create instability on the labor marked and hurt the interests of workers and their employers.



Also, trade unions, which put up a few protests, claim that the document adopted by the Government eliminates any form of protection of workers from prospective abuse from the employers, endorsing “a new form of slavery”. On the contrary, the Executive claimes that the new Code will lead to a more flexible labor market and will reduce black market employment. Here is Prime Minister Emil Boc with more arguments in favor of passing this law:


“The first argument is Romania’s European Union accession and the need to have the Labor Code agree with European directives on the matter. Secondly, the global economic crisis, which hasn’t missed Romania, proved that we needed more flexibility in labor relations”.


The new code has provisions that include, among other things, a 48-hour work week, individual performance targets and criteria set from the beginning of the employment contract, criminal penalties for employers who hire more than five workers under the counter, higher bonuses for night work, and increasing the duration of individual labor contracts from two to three years.



The main purpose of the changes, said Prime Minister Boc, is to create more jobs in Romania. Contested by the opposition, the unions and some employers, the changes in the Labor Code are generally considered useful by human resources experts. However, they admit that some provisions leave room for interpretation, and this could be exploited by employers.


Opinions are also divided with regard to the Government’s promise that new jobs will be created. Some experts expect more people to be hired, getting back to normal once the crisis ends. Others, however, say that this can only happen if there is better communication between the Government and employers.
